INDEPENDENT SERVICE PROVIDER AGREEMENT
Effective Date: 11 June 2026
1. NATURE OF RELATIONSHIP (Contract FOR Service)
You explicitly acknowledge and agree that you are an Independent Service Provider (Freelancer) and NOT an employee of Samarata Wellness. This agreement constitutes a "Contract for Service" and does not create a "Contract of Service" under the Employment Act 1955.
As such, you are not entitled to employment benefits, including but not limited to: EPF (KWSP) contributions, SOCSO (PERKESO) coverage, EIS, annual leave, medical benefits, or termination benefits.
2. STATUTORY CONTRIBUTIONS & TAXATION
You are solely responsible for declaring your own income to the Inland Revenue Board of Malaysia (LHDN). You are solely responsible for your own self-contribution to EPF (i-Saraan) and SOCSO (Self-Employment Social Security Scheme) if you choose to do so.
3. ZERO TOLERANCE POLICY (Code of Conduct)
Samarata maintains a strict Zero Tolerance Policy regarding illicit activities.
Any involvement in, suggestion of, or solicitation of sexual services, "happy endings," or any illegal acts under the Penal Code of Malaysia will result in:
- Immediate and permanent termination from the platform.
- Forfeiture of any pending payouts.
- Immediate reporting to the Royal Malaysia Police (PDRM).
4. INDEMNITY & LIABILITY
Samarata Wellness acts solely as a booking facilitator platform. We are not liable for:
- Any injury, accident, or damage you sustain while traveling to or performing a job.
- Any injury or damage you cause to a client or their property.
You agree to indemnify and hold Samarata harmless against any claims, legal fees, or damages arising from your conduct or negligence.
5. SERVICE STANDARDS & EQUIPMENT
You represent that you possess the necessary skills and certifications (SKM/DKM) to perform massage therapy safely. You are responsible for providing your own equipment (massage oil, towels, optional portable bed) and ensuring they are clean and safe for use.
6. DATA PROTECTION (PDPA 2010)
You agree to treat all Client Information received through the Samarata platform as strictly confidential. You shall not retain, share, or use client phone numbers/addresses for personal purposes or to solicit business outside of the Samarata platform (Disintermediation). Violation of this is a breach of the Personal Data Protection Act 2010.
7. TERMINATION
Samarata reserves the absolute right to deactivate your account at any time, with or without cause, particularly if you fail to meet service standards (e.g., repeated no-shows, poor ratings) or breach this agreement.
